| What is Probate? Probate is a court process by means of which your property gets passed on to your heirs. If you die with or without a will your estate has to be probated if it is over $100,000 in value. If you die leaving behind real estate of any value, whether below $100,000 or above $100,000 your beneficiaries will need to do a probate process. Probate is like a bridge. It enables your property to be transferred from you to your beneficiaries upon your death. Without a probate the county will not transfer your property to your heirs. They need a court order to do so and probate is the process by means of which you get this court order. However, if you died leaving your estate to your beneficiaries in a living trust, your property can be transferred to the beneficiaries without a probate. In California, most probates take nine to twelve months to be probated. Our turn around time for a probate process from start to finish is 6 months. This 6 month period is for an uncontested matter. Uncontested means, your heirs are all in agreement with the handling of the estate.
